Editorial:    A DILAPIDATED GRAVE

 

The International Human Rights Day was observed this year with the traditional “gaiety and enthusiasm” as being observed since conflict erupted in Kashmir. The pro-independence political parties’ had organised seminars at their headquarters to make human rights violations in Kashmir an international issue. One political party had attempted to hold demonstrations and processions before the United Nations Military Observer Group in India and Pakistan (UNMOGIP). It seemed like every year they were inter see competing to highlight the human rights issues through their programmes. It was an occasion for the political parties to demonstrate their strength also. The Editor instead of attending a seminar where he was invited for delivering a speech, choose the day to visit the Christian cemetery, Sheikh Bagh, to place a wreath at the grave of Robert Thorp, who had laid his life in 1868 for upholding the rights of people of Kashmir, long before the Declaration of Human Rights. Though the Editor had been visiting this cemetery once as a student where he came to know about the Robert Thorp contribution but on this visit couldn’t locate the grave. He asked the middle aged gardener about the grave, which he had forgotten. After locating the grave the Editor and young colleague accompanying him placed the wreath on the dilapidated grave. To the pleasant surprise of the Editor the gardener during casual conversation informed that some people do visit the grave occasionally. Even one politician probably an ex speaker long before had promised to reconstruct the grave, but nothing was done. The illiterate gardener knew the sacrifice made by Thorp. He appreciated the idea of the Editor for repairing the grave, which has remained unattended since 1868. The grave facing towards west without even a cross has slightly sunken but the words are quite visible on black stone. “Robert Thorp, age 30 who had laid his life for Kashmir on 22nd November 1868”. At the same time, the Editor learnt later, in the High Court Bar Association meeting on human rights the chief of Dukhtran Millat (Daughters of Islam) had assailed the projection of Robert Thorp (Anglo Kashmiri) as national hero. She was of the view it is tantamount to promoting secularism which is against the ongoing movement and Islam. This statement is highly deplorable and speaks the narrow vision of historical perspective.
 

The Robert Thorp award was established by the Jammu and Kashmir Coalition of Civil Society (JKCCS) in 2003, to pay tribute to the great soul and to acknowledge the contribution made by people towards Kashmir cause after 136 years. It is a pity that Kashmiris for whom he laid his life have not lead any foundation on his name as done by other nations who have been grateful enough to do so to their saviours. Even recently, the Palestinian - NGO Al-Awada the major coalition of Palestinian NGOs has instituted the Rachel Corrie award for non-Palestinian individuals and groups who demonstrate exception, dedication to the cause of Palestinian rights. The Rachel Corrie award was granted for the first time in Toronto to the International Solidarity Movement with which Rachel has been associated. Rachel was an American 23-year-old college student who was the first non-Palestinian activist to be killed in the Occupied Territory by the Israeli Defence Force, on March 16 – 2003.
 

In different countries and nations outsiders contributions have been acknowledged. It is not the religion or the nationality but the contribution, which entitles a person’s recognition in other nations. Like Mother Teresa in India, Ganga Ram’s contribution in Pakistan, Che Guevara in Cuba and Tyndale Biscoe who failed as missionary but made phenomenal contribution for the modern education in Kashmir. There are innumerable such examples in different countries. We have the co-religionists who have been awarded by Padma Bhushan, Padma Vibhushan and Bharat Gorav for the “meritorious services” they have rendered to India. We have the local Foundations who are conferring awards to people as rewards for promoting interests of outsiders and they awardees have been projected as ‘saviors’ of Kashmir. The basic object behind the recognition in the words of Edward Zinn the Palestinian dissident “is the role of intellectuals is to give a people a historical perspective, a philosophical basis and understanding of the economical underpinning of politics and to inspire people with stories of those who have resisted oppression throughout history”.


 

 

J&K HIGH COURT BAR ASSOCIATION’S VISITS JAMMU JAILS

Srinagar: The J&K High Court Bar Association Srinagar visited some Jails of Jammu region, in continuation of its Jail Visit Programmer, in the month of November 2004. The members visited District Jail Jammu and Kot Bhalwal Jail. The Bar members came to know that the trial of some detunes was being held in the jail premises itself in a special court. There was one such under-trial detenue of Heranagar Jail, awaiting trial in the Jail premises.

    In Jammu Jail, there were 35 detenues 40 under trials, and 6 convicts including one woman at the time of the visit, who are being held because of their involvement in the struggle for right of self-determination in one way or the other. Similarly in Kot Bhalwal Jail, there were 300 detenues who were held for similar reasons.

    While interacting with the detenues in the two jails the Bar members were apprised of some common problems faced by the detenues like non-production of under-trials in the courts, denial of specialized medical treatment, denial of speedy trial, persecution rather than prosecution by the public prosecutors, continued detention without the assistance of counsels and cold attitude of amicus-curi in cases they are made available.

The main problem faced by the under trials of district jail Jammu is that they are not being produced before the court for hearings. An excuse given for this by the jail authorities is unavailability of escorts/ movement orders. This practice denies a free, fair and speedy trail, thereby violating the very basic fundamental rights guaranteed to the under trials by the constitution according to the report. There were some under-trials whose cases are pending since last more than eight years.
Also in some cases the inmates have completed their jail term but are not being released. In one such instance a convict namely, Maqbool Hussein s/o Mir Mohd Gujjar r/o Mender Poonch, who is one among the ten convicts serving life imprisonment sentence under the Enemy Agents Act and has completed ten years of imprisonment. The appeal is still pending before the Kashmir Division of Hon’ble High Court.

    Even, when the under-trials are produced at the session Court Jammu some Public Prosecutors hamper the progress of the trial by evading arguing the cases for months together and do not record the statements of the witnesses, who come to dispose before the courts. The bar has quoted some examples and named a particular Public Prosecutor as well who is adopting such practice. In some cases of the detenues of the Kot Bhalwal Jail belonging to the districts of Poonch, Doda, Kishtwar and Udhampur that there detention goes unchallenged for want of counsels at the Jammu Division Hon’ble High Court of J&K. Also in some cases were amicus-curie have been provided to defend the under-trials, it is felt that the under-trials feel that they are not defended honestly and with dedication. They have alleged that amicus-curie comes only to seek dates of hearings and the under-trials are left at the mercy of presiding officers and public prosecutors.

    The other major complaint made by the jail inmates is the denial of specialized medicare to them. They are not being taken to hospital in severe cases like in case of one inmate Muneer Hussain who is suffering from heart ailment and the jail doctor have advised him to undergo Angiography’s, but the same is being denied to him. There are bleak chances of survival for Muneer if the treatment is denied or delayed. Other such cases have also been documented in the report.
The detenues also revealed that they were being kept with the hardened criminals and that was in violation of the jail manual and was very depressing for them.

    There are some 60 foreigners undergoing endless detention in Kot Bhalwal Jail and they are not aware of their fate. The Bar concluded the report on the remarks of one convict as having said, “There is no happiness to an inmate if some relief is given to him and there is grudge if they are subjected to any hardships, since their most cherished right of personal liberty has been abridged without adopting the due course of law”.
 



TATA SUMO DRIVER KILLED IN IED BLAST

Pulwama, Dec 5: A Tata Sumo passenger vehicle carrying soldiers of 1 Rashtriya Rifles (RR) was blown into to pieces in an Improvise Explosive Device (IED) blast at Nayena Batpora in Pulwama district of South Kashmir. Apart from the soldiers, one counter-insurgent and the driver of the vehicle Mehraj-ud-Din Khan s/o M. Ramzan Khan of Khankah-e-Sokhta, Fatehkadal, Srinagar were also killed in the blast. A prominent Congress activist of Srinagar Abdul Ghani owned the vehicle.

    As soon as the body of the Sumo driver reached his native town, people came out protesting and mourning over the death. The SHO, Pulwama handed over the badly mutilated driver’s body to his family members, who alleged that the troops had forcibly taken him for the operation.

    According to a daily newspaper published from Jammu reported, that a contingent of army led by Company Commander of 1t RR Zainapora, Shopian camp, Major Lalit Kumar, stopped a private Tata Sumo vehicle bearing registration No. JK01F-1803 near Khanabal, Islamabad to reach their camp, after carrying an operation in Arwani area last evening. The security personnel took a non-traditional route to Zainapora and as they reached near Naiyna Batpora village, militants triggered the IED, which killed the inmates and destroyed the Sumo.

    Protesting over his death, the Tourist Taxi Operators Association exhibited a one-day token strike the very next day to protest against the killing of their colleague and demanded a proper inquiry into the matter and stop the practice of using passenger Sumo’s for operations by the forces.

    Highlighting the death of Mehraj-ud-Din, the Tourist Taxi Operators Association members while talking to “The Informative Missive” bring forth their concern over the manner the security agencies were forcibly using the private Sumo vehicles for carrying out operations in far flung and vulnerable areas, often resulting in loss to life and damage to the vehicles.

    The Sumo Taxi Operators had expressed their resentment to the concerned authorities at least one month before the incident, in a letter addressed to I.G.P, Kashmir range, Ref no: TTOA/04/4010-16 dated 13/11/2004. The letter had explained in detail the modus operandi used by various security agencies to deal with the Sumo drivers especially on Srinagar-Pulwama route.

    They stated that security agencies intervene on various routes on which the Sumo vehicles ply. They stop the vehicles and direct the passengers to get down and board the Sumos themselves for their own destinations. This causes inconvenience to the passengers and shows the high handedness of the security forces.

    They had further stated in the letter that though they are not against the use of Sumo vehicles by security agencies, but they should hire them in a proper manner from the Taxi stands itself or even call them on phone. The manner in which vehicles are taking is illegal and violation of human rights.
Through the letter they had appealed to the IGP to convey their problems to the concerned security agencies and arrange their meeting with the concerned security agencies especially based in between Srinagar-Pulwama route via Kakpora, where such incidents are the highest. The business in the area had received severe setback as the drivers refused to ply on the said route and thus resulted in inconvenience to the people of the area.

    The copy of the letter was also sent to Divisional Commissioner, Kashmir, DDC Pulwama/ Anantnag, Sector commander HQ sector 1 RR Khanabal, Kashmir, Sector Commander HQ Sector 2, RR Qazigund, Kashmir.

    Mehraj-ud-Din is survived behind old parents and three unmarried sisters. The association members gave details of some Sumo vehicles, which were badly in need of repairs as a result of forcibly taken for operations by the security agencies and plied on bad roads.
 


TORTURED PERSON AWARDED COMPENSATION 11 YEARS AFTER INCIDENT

Srinagar, Dec 25: Failing to get clearance from the CID department, fifty intending pilgrims including two lawyers have been stopped from performing Hajj this year. This has caused a major set back to the pilgrims who in spite of all odds had intended to make the sacred pilgrimage. Jinxed amidst tears, the pilgrims feel completely shattered, as at the nick of time they have been sentimentally and physically deceived. This pilgrims progress blockage received wide spread condemnation from people belonging to different walks of life.

    Thousands of Muslims in J&K seek permission for Hajj, which is one of the five pillars of Islam every year. The Hajj committee of India is empowered to make arrangements for taking pilgrims to Mecca, Saudi Arabia. The Committee invites applications from the intending pilgrims through State Hajj Committees, which are to be filled and deposited in the manner as mentioned in the application form. Except for those who have performed Hajj during the last five years, any Muslim can go for Hajj.

    This year Hajj committee sought applications from intending pilgrims in J&K for the Hajj to be performed in 2005. Accordingly all intending persons submitted their application forms along with a bank draft of Rs.10, 500 with their respective District Development Commissioners (DDC). The DDC forwarded the applications to the office of convener, State Hajj Committee from where it were sent to the Hajj Committee India, for preparing Hajj passports, identity cards and air tickets. Completing subsequent formalities and depositing the balance amount, the Hajj committee intimated all the pilgrims of J&K, fifteen days in advance about the flight schedule, which began from 13-12-04. The schedule was also made available on website. Intimidated about their flight schedule, intending pilgrims went to the office of convener, State Hajj Committee for collecting their travel documents etc.

    However, fifty pilgrims whose names were in the flight schedule were told that their documents had not come as such they should come after some days. Waiting for few days, these people went to the office of the Convener, State Hajj Committee again on 11-12-2004 for collecting their travel documents etc. But they were simply told that though their documents were complete in all respects and have been received by the state Hajj committee, but they cannot go for Hajj because they have not been cleared by the CID authorities.

    Hajj is once in a life occasion. People utilize the savings of their lifetime on this pious and purely religious ceremony. A woman and minors cannot perform Hajj alone without a Mohharam (immediate male relative).

    The fifty pilgrims stopped from performing Hajj include men and women. As such the families of the men stopped cannot go for Hajj as per the Islamic law. This has been vice versa as those whose wives have not been allowed are not ready to perform without them. In a way it is not only these fifty persons, but also the actual no. of intending pilgrims who would not be able to go will be much more than fifty as most of these fifty persons would be accompanied by their spouses who cannot go due to this decision. It is loss of both time and money.

    This decision culminates in the violation of Article 25 of CrPC, which guarantees religious freedom and non-interference in religious matters. It is a fundamental right under Indian constitution and thus illegal.

    It’s important to note the manner these fifty people have been stopped for performing Hajj at the very last moment. These fifty persons had even vaccinated themselves, which is compulsory for landing in Saudi Arabia. They had also taken leave of their relations and friends. They had only to board the aircraft on the scheduled date for Jeddah. The Hajj Committee in Makah and Medina had also arranged their accommodation. The physical fatigue and mental agony suffered by these persons at the hands of administration can only be imagined.

    There is another aspect to this issue. The Govt. is likely to stop anybody from leaving the country if there is any case against the person pending in the court and if the Govt. feels that the person may escape in the cover of Hajj. Even in such circumstances a person can seek permission to travel on religious grounds. But it is strange that no case is against any of these persons restricted from going to the pilgrimage. It is also likely that a person may preach or say anything against the administration in a foreign country. But a Muslim going for Hajj is not going to cause any problem to public order, or indulge in any ‘extracurricular’ or immoral activities. It is a religious obligation and thus a person keeps a religious profile, whatever his ideology. The administration should view it from such angle as well. It is pertinent to mention that J&K is the only state where CID dept. can interfere in a vital and sensitive issue like religion and influence the authorities to such an extent. This speaks volumes about the state of affairs and who actually runs the writ.

    On Dec 24, the High Court directed the State Hajj committee (SHC) to release travel documents of two lawyers and their families so that they could undertake the holy pilgrimage. The judgment was delivered on a public interest litigation filed in the court by the High Court Bar Association (HCBA) asking for compensation to the tune of Rs. 5 Lakh each to those 50 intending hajj pilgrims including the Bar President Mian Abdul Qayoom who were not allowed to perform the Hajj by the State govt. citing “Security reasons”.
 


TORTURED PERSON AWARDED COMPENSATION 11 YEARS AFTER INCIDENT
 

Srinagar, Dec 17: The Additional District and Session Judge Srinagar High court ordered the State government and Union of India who is controlling the army to bored the amount of Rs 5 lakh equally in share for the suffering borne by Manzoor Ahmed Naikoo because of the injuries inflicted upon him.

    Viewed thus, it was held by the court that the plaintiff is entitled to claim the compensation and damages from the defendants including Rs 1 Lakh which the plaintiff spent on medical treatment comprising of four surgical operations and Rs 4 Lakh by way of monetary loss for the torture, which left him unfit to carry on any business, vocation or profession.

    Therefore decree for recovery of Rs 5 lakh with interest at the rate of 5% per annum from the date of decree till final realization was passed in favor of the plaintiff and against the defendants.It’s pertinent to mention here that on early morning hours of 28-9-1991, army personnel of Dogra-2 cordoned of village Palhalan where Manzoor Ahmed Naikoo along with his family resided. People were asked to come-out of their house. While males were made to assemble in the compound of a local Government High School, females were asked to assemble near the tomb of the Jamia Masjid of the village. Later army directed males to form the rows.

    An army official took Naikoo to one of the rooms of the school building and handed him over to some other army personnel; five in number. Thereafter, Naikoo’s hands were tied backwards and made undressed. His penis was tied with a piece of cloth and set on fire. It was painful and Naikoo kept crying and screaming. The army accused him to be a militant and asked him to hand-over the arms and ammunition. Pleading his innocence, Naikoo was taken by the army to his house and beat him ruthlessly. Later he was asked to lie down with two army personnel standing on his arms and other two on his legs. A wooden stick was inserted into the rectum of the Naikoo, which made him bleed profusely. Then his head was forcibly dipped into a tub of water and he was asked to drink it. In a half dead condition, he was shifted to some other house. There he was given electric touches. Thereafter, he was thrown on the floor of the room. One of the Army men put his feet on his throat and throttled the same for some time. The army kept intensively questioning and Naikoo kept pleading his non-association with any militant group. The brutal consistent torture made him unconscious. He was again dragged to the school building. At 7:00 in evening he was handed over to the village folk in the school compound.

    Naikoo was taken to his house by his kith and kin who took him to the SMHS Hospital Srinagar. Naikoo was operated upon in the hospital where he had to remain till 30-10-1991. Again on 24-12-1991 he was admitted in the SHMS hospital and underwent one more surgery on 7-1-1992. He was discharged on 20-1-1992. On 13-03-92, he had undergone one more operation because of the intestinal injuries. One more surgery was to be done on 8-12-1992. Naikoo got admitted in the hospital, however, doctors discharged him and said that this operation cannot be conducted in valley. For this reason and limited resources he is ailing till date.

    A shopkeeper by profession, he had to sell the merchandise lying in his shop on throw way prices to meet the treatment expenses. For the depleting financial condition, Naikoo sold a part of his cattle to meet the required needs. The army personnel stole earlier seven thousand rupees, a watch costing Rs. 700 and twenty fowls, which were in Naikoo’s shop.

    Following the inhumane treatment meted out to him and false accusations charged against him, Naikoo filed the suit against the Dogra-2 in the Additional District Judge Srinagar on 26-5-1993 demanding a compensation of Rs. 40 lakh by way of the damages for the loss he suffered.

    Eleven years later the court came out with the judgment entitling the plaintiff an amount of Rs 5 Lakh as compensation to the victim. The state has admitted in the written statement the arrest of Naikoo by the Dogra-2 and had alleged that the plaintiff was involved in terrorist activities. However, they denied that he was tortured. Nobody had appeared from Union of India despite the fact that they were issued notices by the court and ex-party proceedings were initiated against the Union of India.


 

AFAD AWARD’S AASIA JEELANI POSTHUMOUSLY

Srinagar, Dec 12: Aasia Jeelani- a Human Rights Activist who died in a landmine explosion on April 20 2004 while monitoring the Parliamentary elections has been awarded posthumously by an International Organisation for her contribution to the families of the disappeared in Kashmir.
According to reports, Philippines-based Asian Federation Against involuntary Disappearances (AFAD), conferred award on Aasia during a conference organised on the eve of International Human Rights Day on Dec 11 in Indonesia.

    A documentary film “Aasia-----A Quest for Justice” produced by Jammu and Kashmir Coalition of Civil Society (JKCCS) was also screened during the “Healing Wounds and Mending Scars” conference held in the Indonesian capital Jakarta. The delegates attended the conference from Indonesia, Kashmir Pakistan, Philippines, Sri Lanka, Thailand, Netherlands, Guatemala, the Latin American Federation of Associations of Relatives of the Disappeared Detainees (FEDEFAM) and leading African organization RADIEF.

    “Indeed, the issue of involuntary disappearance is a truly global problem, affecting, from diverse cultures and continents from Asia, Africa, Europe and Latin America. To counteract this lingering evil, a global response is deemed imperative to chastise the perpetrators from ever happening this again,” the participants observed.

    They called on all governments, especially Asian governments “who are largely responsible for these deeds,” to finally adopt the Draft UN Convention on the Protection of All Persons from Enforced or Involuntary Disappearances. “It is crucial that this be adopted before the end of 2005, being the crucial year for this future treaty.
 


PIHRO CONFERS AWARD ON LATE AASIA JEELANI

Dec 12: The Pakistan International Human Rights Organisation (PIHRO) conferred posthumously award on late Aasia Jeelani, who lost her life in a landmine blast on April 20, 2004.

According to influential Pakistan daily “The News”, the award was conferred at an impressive ceremony held at National Library’s Auditorium in Islamabad on Friday, Dec 10. Pakistani’s Former Foreign Secretary, Akram Zaki gave the award in the form of shield to Convener All Parties Hurriyat Conference, “Azad Kashmir” chapter, Muhammad Farooq Rehmani, who received it on the behalf of late Aasia Jeelani.Rehmani expressed gratitude to the PIHRO.
 


TROOPS FIRE ON PROTESTERS, 70 YEAR-OLD KILLED

Baramulla, Dec 1: A seventy -year-old person was killed and many injured in an unwarranted firing by the troops of 13 Rashtriya Rifles (RR), on November 30 while they were rebelling against the atrocities committed by them during a search operation in the Hakbara, Yarbalpora and Pahlipora villages of Baramulla district since 28 November.

According to the villagers, during search operation troops beat men, women and children, ransacked household goods and molested women and also tearing off their clothes. The soldiers then fled the village and prowled on the outskirts. Next day, on Tuesday (Nov, 30) morning, troops returned and announced from mosque that curfew has been imposed in the village. They asked the men to assemble at one spot and selectively beat up many of them. The villagers rebelled, broke the siege and tried to march towards Sumbal but faced a volley of bullets.

“Troops asked to us remove the pherans (traditional dress) and fired indiscriminately. We run for the cover and later came to know that many were wounded,” Ghulam Hassan, a villager said.
Many were wounded in the incident, some fatally. A seventy-year-old identified as Abdul Khaliq Sheikh who was injured in the firing succumbed to his injuries at hospital later.After the incident, Sub District Police Officer (SDPO), Ganderbal and Station House Officer (SHO), Sumbal assured the protestors that nobody would be manhandled, the protestors began to assemble but were again beaten, they alleged. Till 4:00 pm, the bodies of the deceased had not reached the village.

A spokesman of army Kilo Force however told that troops had cordoned off four houses in the village after a tip off that some militants were hiding there. “Some villagers stoned the search party and wounded an officer and three jawans who are being treated at PCR hospital in Srinagar. The mob also attacked a jawan and a policeman who fired in self-defense in which Abdul Khaliq got killed and two others were wounded,” he said, “it becomes difficult to identify a person in a mob.”
The spokesperson said, the villagers had broken the cordon and marched to police station.
 


POLICE ARRESTS EX-SPO IN EXTORTION, SODOMY CASES

Srinagar, Dec 6: Two years back, Amir Khan, (name changed), an 11th class student, was approached by a clean-shaved man with a deep scar between the brows, while standing outside his coaching center at Khanyar. “He showed me his identity card issued by the Special operation Group of Police and asked me to board a gypsy driven by a man in civvies. He even told me all the details of my family,” said Amir. Later he disclosed his name as Tiger and snatched all the cash Amir was carrying. He threatened to harm Amir in case he disclosed anything about the incident.
A year ago, Junaid, 14, (name changed) was on his way to a tutor in Peerbagh when he was asked to board a gypsy by the same man. Here, he also identified himself as SOG recruits. Later he was taken to Lal Ded Hospital where the stranger tried to sodomise him but Junaid jumped off from the hospital window.

In this year 2004 Abir (name changed) from an affluent family was strolling on bund area near Lal Chowk with his friends when a man with same mark on forehead stopped before them to accompany him to a nearby police Station, said Abir. But this time he was carrying a police and army identity card. “He snatched all the money and forced me to lick the road”, Abir says.Now, police claimed to have arrested the scar bearing person on forehead before two weeks ago identified as Nissar Pallu, ex-SOG man, after following a complaint of extortion and torture by a parent whose son was the victim. Police believes that Nissar Pallu was also involved in cases of sodomy. The modus operandi of the accused had been to keep track of children belonging to rich families and extort money from them and in some cases sexually abuse them. Interestingly, Nissar Pallu has been arrested seven times in the past. Many criminal cases are pending against him. “Every time he was released,”.

The Inspector General Police (IGP) Javaid Makhdoomi said, Nissar Pallu had joined the infamous Special Operation Group seven years ago during the heydays of ruthless government-patronized Ikhwanis. After number of complaints he was terminated from the police. “He was working as SPO and was terminated because of his unlawful activities”.According to Inspector General of Police, Preliminary investigations indicate there was a strong case against Pallu “All sources would be used to make sure that he will not get any reprieve from anywhere,” he adding, he was involved in sodomy cases.
 


60-YEAR OLD WOMAN RAPED BY TROOPS

Srinagar, Dec 22: Once again the shameful act of rape has been repeated allegedly by the Army troops of 3 Rashtriya Rifles (RR) in the Pahalgam constituency of J& K Chief Minister on Monday night of Dec 20, 2004. This time the victim was not a teenager but a 60-year old aged woman, Hakim Jan w/o Syed Alam, a mother of four children. On the fateful night of Dec 20, troops after forced their entry inside the mud house of Syed Alam dragged her wife Hakim Jan into another room and allegedly raped her. While the whole family resisted against the act, troops suppressed the cries of the other family members by their constant threats and beating. After hearing the news thousands of the villagers come out on the road and raised slogans against the ruling regime.

    The police registered the case and have started investigation into the matter. Police has filed FIR 116/2004 in Pahalgam, Police Station. However, the Senior Superintendent of police, Islamabad and defence spokesman, quoting ‘medical examination report of the woman’ said that no rape had taken place’. The Commanding officer of 3 RR and police officers reached the village and assured the angry protesters that anyone guilty would be punished. While asked to identify the accused, Hakim Jan replied that the accused soldier who was fleeing from the house after committing the act was caught hold by her dumb son and bitten by him on his neck. According to her, the accused soldier was named by some sources as Kishan Bahadur. The fleeing soldiers thrashed the victim’s son leaving him in a half dead condition.

    On Dec 28, the Army has dismissed non-commissioned officer Lance Havildar, Krishna Bahadur awarding him one-year rigorous imprisonment for “misbehaving” with a 60-year-old Hakim Jan of Salar Pahalgam. According to a defence communiqué, the army while taking serious note of the act of misconduct by the soldier tried him in a Court Martial under army law. “The soldier has been dismissed from service and awarded one year rigorous imprisonment,” the communiqué said adding the soldier would be handed over to police at Central jail Jammu for the execution of sentence.


APDP BLAMES SOCIAL ORGANIZATIONS FOR APATHY

Srinagar, Dec 25: On the monthly sit in of Association of Parents of Disappeared Persons (APDP) its Patron Adv. Parvez Imroz expressed his dismay over the social organisation for not providing any support to the victims of militancy. He also criticized Hurriyat Conference (A) for asking National Conference (NC) to tender an apology for the human rights violations, which have taken place during their regime. Imroz said, they have no right to make such statements on behalf of the victims. Imroz further said that the civil society components like the religious groups and social organizations do not come forward to help the victims of militancy“. If the social organizations would raise funds for the victims like on the eve of Eid, they will feel a lot relieved from the sufferings even they would not feel the need of any SRO 43 jobs and the ex-gratia relief,” observed Imroz.

    He said that people only blame the victims for accepting jobs under SRO 43 and ex-gratia relief, but they don’t realize that this is their own fault since they don’t come forward to help them.
However, the parents and the relatives of the disappeared persons said in one voice that they would never excuse the human rights violators. “Who are the Hurriyat people to ask them to tender apology when we are the sufferers,”.

    On the occasion all the APDP members had worn head bands inscribed with the names of there disappeared near and dear ones. They had covered their faces with replicas of Mufti Mohammad Sayeed which were inscribe with “Mufti Dracula” in protest of disappearance during the Mufti regime so far. Jammu and Kashmir Coalition of Civil Societies (JKCCS) headed by Parvez Imroz, has put the figure of disappearances during Mufti rule at 144.

Among the APDP members, was Taja of Rakh Shelal (Handwara) whose son Muhammad Ramzan has been missing after his alleged arrest by the forces 10 years ago? He was a student of 10th standard. Taja says she has four daughters and then elder son who according her has been smarting under the torture, which the forces subjected him to. She is in fix how to manage the affairs of her family given the ailing health of her husband and the half alive son.
Another other youth Sartaj Ahmad Ganie of Kulgam was arrested by 9 RR this year according her mother. “Though he is in their custody but they don’t set him free. I have five daughters and my husband is a labourer who will take care of all my daughters,” she said. The APDP members threatened that they will commit suicide, if their loved ones are not handed over to them.

 


MAYHEM IN TRAL: 4 KILLED IN FIRING

Dec 30: Three persons including a mother-daughter duo were killed and five others severely injured when forces fired upon a passenger bus at Tral area of South Kashmir. According to reporters around 10:00 am a bus traveling from Pulwama to Tral was stopped by security personnel of 42 RR asking passengers to get down for checking. “As soon as one of the passengers got down forces started firing upon the bus said, Abdul Ahad Mir wreathing in pain in Sher Kashmir Institute of Medical Science (SKIMS) hospital wearing blood-stained clothes with three bullet holes. Abdul, who was traveling in the bus, had a narrow escape when bullets hit his ear and waist. “We cried we are civilians but they burst volleys of bullets upon the bus’, Abdul said.
Terrified Abdul saw a woman dying inside the bus as they huddled on the aisle in the bus, ducking and struggling to survive. “I saw bullet hitting number of people and a girl was crying that her mother is dead,” recalls Abdul. He asked the girl to run for life. Unfortunately, the daughter crying for help of her mother too received bullets. After half-an-hour both mother and daughter breathed their last inside the bus. They have been identified as Rifat Jan and Jamila, respectively daughter and wife of Muhammad Yusuf Shah of Pulwama.
    But the ordeal for the passengers did not stop. After the firing, passengers with bullet injuries were asked to get out of the bus. Irrespective of the injuries the male passengers were ordered to put off all clothes including underwear and paraded in open. “I saw nude men kept on the roadside with blood splattered on many,” said Parvez, an eyewitness, traveling in another bus and stopped by the forces near the location of the incident. For one hour passengers were kept nude.
Denying that troops fired indiscriminately on the passenger bus, a defence spokesman while giving details of the incident said that the militant carrying a pistol got down from the bus and fired at the searching party injuring many jawans. He was identified as Abdul Rasheed Bhat a resident of Bijbehara having links with HM.
    On Jan 1st, the Deputy Commissioner, Pulwama has asked the state government to order a judicial inquiry into the firing incident. Taking serious note of the incident DC Pulwama Khurshid Ahmed Ganai wrote a letter to BSF asking it to hand over the troopers responsible for the firing and co-operate with the police in the investigation. Meanwhile, the police station, Awantipora has registered two FIRS’ against the BSF. One FIR has been registered for resorting to indiscriminate firing on the bus carrying passengers and another for killing innocent civilians at Medora, Tral.
 



CUSTODIAL KILLING HC NODS ON CASE AGAINST BSF

Srinagar, Dec 7: The State High Court directed the State Government to seek permission from the Central Government for filling criminal case against two Border Security Forces (BSF) officials allegedly involved in the custodial killing of a student from Soura-Srinagar.

According to sources, in December 1992, BSF personnel of 107 battalion arrested a 12th class student, Mehraj-u-Din near Noushera while he was going to school. When Mehraj didn’t return home in the evening, his parents informed the local police station, but nothing was done. Next day, BSF Sub Inspector Gurbachan Singh handed over the body of Mehraj, bearing torture marks, to police station, Soura. The parents of Mehraj filed a case in the court against the BSF for killing the boy in custody. Police also registered an FIR 260/92 under section 302 and started investigation into the killing. The court issued orders to police station, Soura to hold investigation. The investigation revealed that three BSF personnel, Sub Inspector B I Singh, K. K. Verma and Inspector Ras Bahadur were involved in the custodial killing. The government informed the court that Sub Inspector B I Singh had died during the course of investigation while as K. K. Verma had retired from his services and Inspector Bahadur Datta had been transferred to West Bengal. However, the High Court has asked the government to seek permission from the center for filling a case against the accused.

 


COURT ORDERS PSA DETENUE’S RELEASE

Rajouri, Dec 7: Justice SK Gupta of Jammu and Kashmir High Court wing has quashed the detention of Basharat Hussain s/o Mohammad Nazir r/o Nagrota teshil and district Rajouri who was detained under Jammu and Kashmir Public Safety Act by District Magistrate Rajouri.
While quashing the detention Justice Gupta observed that the accused was admittedly in custody at the time of passing the detention order, so is also admitted by the detaining authority in their counter filed to the petition. After hearing both the sides, justice Gupta quashed detention of the detunue and directed his release from the custody provided he is not required in any other case /offence or matter.

YOUTH SHOT DEAD IN AWANTIPORA
Anantnag, Dec 8: Troops belonging to 55 Rashtriya Rifles (RR) allegedly shot dead a civilian at Awantipora in Anantnag district of south Kashmir.According to reports, troops’ fire at Shamim Ahmad Dar s/o Ashoor Dar of Panzgam, Pulwama in the morning, during a patrol. However, troops claimed Shamim Ahmad Dar was a militant and recovered a pistol and a hand grenade from him. The residents have scotched the claims of Victor Force spokesman saying that the deceased youth was not a militant.

HC QUASHES DETENTION ORDER
Srinagar, Dec 8: The High Court on Dec 7, quashed the detention order of Mushtaq Ahmed Hajam, Abdul Rashid Kral and Noor Muhammad Khan with directions to the state to release the detainees forthwith, senior lawyer GN Shaheen said.

CRPF MAN SHOOTS OFFICER
Srinagar, Dec 8: A CRPF personnel guarding the residence of Chairman ‘Peoples Conference’ and Hurriyat constituent, Sajad Gani Lone, in Sanatnagar on Wednesday Nov 8 shot dead his Officer, Sub-Inspector Prem Singh. The shootout created panic in the area.

YOUTH MISSING
Srinagar, Dec 12: A youth identified as Zahid Ali of Mughal Mohallah, Chatabal a jacket maker by profession was abducted by gunmen in civvies on Dec 2, 2004 from his shop.
According to Zahid’s mother, seven persons traveling in Sumo vehicle called on him and told that SHO, Parimpora wanted to stitch some jackets. “He was taken along but he didn’t return. He couldn’t be located in Parimpora, police station or elsewhere,” she said. The aggrieved family has sort the intervention of the Chief Minister in this regard.

YOUTH KIDNAPPED IN NOWGAM
Budgam, Dec 12: Unidentified persons kidnapped a youth in Jeniahama, Nowgam on the evening of Dec 10. Reports said, Shabir Ahmad Kalwal s/o Muhammad Amin Kalwal r/o Kirhama was picked up by some unidentified Maruti-borne persons for unknown reasons. Since then nothing is known about his whereabouts.

CIVILIAN DIES IN IED EXPLOSION: LOCALS SAY SOLDIERS FORCED HIM TO DIG OUT IED; ARMY DENIES
Baramulla, Dec 13: A youth lost his arm and suffered multiple injuries while unearthing an IED allegedly under the pressure of troops on the roadside near Wusan, Pattan in north Kashmir. He was shifted to hospital where he breathed his last after couple of days. According to the locals, a civilian Ghulam Qadir Waza s/o Ali Muhammad- a chef, while returning to his home at Raipora, Palhalan was stopped by a patrolling party of RR near Wusan. The soldiers asked him to dig out an IED planted on the roadside. According to residents the device exploded when Waza was digging the earth. On spot Waza lost his arm and suffered multiple injuries due to the impact of the blast. He was taken to Soura Medical Institute in critical state where he succumbed to his injuries after couple of days. Thousands of people staged demonstration against the incident. The protesters demanded the local army camp to be shifted from the area. However, the Sub Divisional Police Officer, Pattan denied that army forced Waza to dig out the device. “It is totally wrong, nothing like that has happened” he said.His killing evoked widespread protest in the area for two consecutive days, which forced the police and the army authorities to probe the incident. On the other hand spokesman of Kilo Force claimed that army was nowhere near the spot when the incident occurred. To probe the killing the army and police have initiated separate inquiries into the killing.

RAPE INCIDENT IN LANGATE YOUNG BOY’S MENTAL AGONY GOES UNNOTICED
Dec 14: The rape incident at Bader-i-Payeen, Langate shocked people living across the Kashmir valley. But very few people know about the plight and the mental agony of the family especially of Ghulam Nabi Dar whose mother Ayesha Begum and 10-year-old sister Shabeena were raped on November 6.Thirteen-years-old Ghulam Nabi Dar a fifth standard student in the English medium school had to face the wrath of Major Rehman on the day of the incident as his father Abdul Majid Dar was not present at home. Besides beating up mercilessly by the army Major, Ghulam Nabi was also interrogated for hours. The whole incident took place when Ghulam Nabi was sleeping. In between 10:30 pm and 11.00 pm, the army personnel led by Major Rehman barged into the house and caught hold of him.
    According to Ghulam Nabi, the army Major asked him to hand over a girl and was not ready to listen a word. Angry he categorically rebuked the army Major and outrightly told him that there was no way in the world that he would hand over any of the female members to the Major. This infuriated the Major who asked his fellow army men to take him for interrogation. He was banged with the wall by the Major and was whisked away by the other army men. Dar also faced the wrath of the army as he being the only educated person in the house started replying the queries of Major Rehman in Urdu. His instantaneous reply caused embarrassment to the Major and it was due to this bravery shown by him that the army Major faced stiff challenge from this little kid.

    The fear psychosis has forced this fifth class student to remain indoors most of the time with the result he has not been able to attend his school for the last so many days. “I feel that if I move out of my house any army man would catch hold of me and there are chances that I may get killed,” he added.

SOG TERROR IN SHOPIAN FORCES PEOPLE TO FLEE
Pulwama, Dec 15: Special Operation Group (SOG) of police forced migration of large number of people at Imam Sahib area in Shopian following a militant attack that left two SOG men dead and two others injured. Reports from Imam Sahib said, normal life was paralyzed after the incident as SOG men have “let loose a reign of terror in the area”. A large number of people have migrated to safer areas.
“We are scared to return home. The youth are being picked up and subjected to severe torture in custody. Following these incidents many youth and other middle aged men preferred to leave the area” said a youth who had taken shelter with his relatives in the city.

EXTORTIONIST HELD
Anantnag, Dec 15: Police arrested two men, Gowhar Ahmad Dar s/o Shabir Dar and Gowhar Ahmad Wani s/o Ghulam Mohammad Wani of Sofshali, Kokernag in Anantnag district on Monday Dec 12. Police said the duo extorted money from the people and recently had extracted Rs 30,000 on gunpoint from Muhammad Ibrahim Wani of Sofshali on Dec 11.

FATHER-DAUGHTER DUO KILLED
Kupwara, Dec 16: Some unidentified gunmen abducted a man and his daughter at Kawari, Handwara and subsequently killed them. According to the reports, Abdul Razak Shah, 40, s/o Abdul Samad Shah of Karepora and his daughter Mubeena Bano, a 10th class student were abducted by a group of burqa clad persons in a maruti van without registration number. Mubeena was bundled in the van while she was trying to save her father and subsequently killed.

INFILTRATION INTO J&K DOWN BY 60%: PATIL
Dec 17: Home Minister, Shivraj Patil on December 16 claimed that infiltration in Jammu and Kashmir has come down by 60 %. The Law and order situation in Jammu and Kashmir and the North-East “is improving but has not totally improved,”Referring to Jammu and Kashmir, he said ‘terrorist’ incidents had come down by 24% while killings had reduced by 12 % in the troubled state. However, naxalite violence in certain states was a cause of concern for the government and every effort was being made to tackle the situation, he added.It had decided to add 209 more battalions of Para-military forces. Also, 56 Indian reserve (IR) battalions would be created. Modern weapons, vehicles and modern communication systems would also be provided to the Para-military forces.

    He said Pakistan had assured India that it would not allow its territory to be used for anti-Indian activities. However, Islamabad had so far not been able to put its promise in practice and it was still making efforts in this regard. Patil denied that different agencies were giving different figures on the level of infiltration in Jammu and Kashmir. The figures were always based on the assessment of various agencies.

GUJJARS BEATEN ‘SAVAGELY’ IN KELLAR VILLAGE
Dec 18: In Kathwal Nagbal, a forest terrain between Shopian and Keeler areas of Pulwama district at least 30 Gujjar and Bakerwals including women and children were allegedly beaten by the troops of Rashtriya Rifles.

Their sin was only not to recognize the two persons who disappeared in the thin forests in front of the troops. Hundreds of the people protest against the alleged atrocities by RR soldiers. Protesters carried two persons Aziz s/o Chotoo Poswal and Kaka s/o Mir Poswal residents of Kathwal Nagbal, on their backs in semi-dead condition. The duo bore torture marks on thighs, hands, waists and feet. The protesters said troops branded an innocent couple as collaborators of militants because they couldn’t catch or kill two persons who gave them a slip and disappeared into the forest area that lies on the right side of the road. The duo was wearing Pherans (traditional dress), and was very clearly seen by the troops as well as by some villagers. Mohammad Shafi, s/o Kaka said the troops were attacked by the unknown persons and they (RR) retaliated. He said the exchange of fire continued for several minutes without any casualty on either side. When the firing stopped soldiers asked all the residents to assemble at one spot. “While we were assembling, we heard an officer abusing a soldier for letting those unknown persons go”, said Aziz leaning on one side of his body with burnt hips that according to him were burned with a kerosene stove. Aziz said, the soldiers rebuked by his officer, to save his skin, pointed towards Kaka and told the officer, “We saw this man and his wife walking with those two persons. They came out of his house.”

“Another officer photographed Kaka, his wife and his daughter and asked villagers, who were those two persons? We replied your soldiers and we saw those persons together. If you can’t recognize them how can we”, Aziz added. Hearing this, the residents said, the soldiers went berserk and savagely beat up many persons. The doctor on duty at district Hospital Pulwama said both Aziz and Kaka have suffered trauma injuries on soft tissues and have torture marks on backs. The doctors said, meanwhile, Deputy Commissioner, Pulwama, A. A. Lateef-u-Zaman assured the protesters that necessary actions would be taken against the guilty persons.

J&K SEEKS EMPLOYMENT PACKAGE FOR KP’S
The State government has sought special employment package for Kashmiri Pandits staying back home to address the alienation amongst the minority community in the valley.This follows the massive Rs. 150 crore packages for the migrant Kashmiri Pandits agreed in principle by the Central government for construction of two room sets for the minority community members in Jammu. “We give priority to Kashmiri Pandits who have stayed back home. They have faced a lot of hardships during the turmoil days but they have not migrated from the valley. We value their dedication. The Pandit youth are now facing unemployment problem. We have decided to seek, minister for revenue, relief and rehabilitation. Around 700 families are currently putting up in Kashmir valley. Of them, majorities are living in the districts of Srinagar, Anantnag and Pulwama.

    After massacre of 23 Pandits in Nadimarg last year, the Pandits staying back home had been demanding resetting in special clusters in Kashmir. Besides rehabilitation, they had forwarded three demands to the government including economic rehabilitation, solution to unemployment and migrant status to the Pandits living in Kashmir. Official figures suggest that nearly 2.5lakh Pandits have migrated to different parts of the country since March 1990.

    Around 56380 migrant families are living in different parts of the country .Of these 34644 families are staying in Jammu and 19338 in Delhi. A total of 4778 families in Delhi are still living in camps. The government has sanctioned Rs. 20 crore for construction of safe houses. The ambitious project at Sheikhpora is nearing completion. Reports suggest that the 1300 migrant Pandit families who had applied for rehabilitation in Sheikhpora will be settled by next March. The government has also decided to identify the land at different district and tehsil headquarters where the clusters for migrant pundits will be constructed. In this regard, the government is contemplating to start work on cluster in Harnag, Anantnag.

HANDWARA RAPE ACCUSED TO FACE COURT MARTIAL

Dec 18: The army ordered court martial against the accused army Major Vijay Kumar alias Rehman in the widely published and condemned case of rape of ten-year-old girl Shabnam and her mother Ayesha on November 6 in village Badra Payeen of Handwara area of Kupwara district. The court martial will commence from December 20. General Court Martial (GCM) with Brigadier Syed Ata Hasnain as presiding officer will try the accused.

According to defence spokesperson, the court will be held in Uri that is outside the jurisdiction of the place where the incident had occurred. “We found something in the probe ordered into the incident. After that we ordered a court martial”, said defense spokesperson. Meanwhile, police investigating into the case have collected sealed DNA report from Chandigrah that would be produced before court as evidence.

According to govt. sources probe failed to yield results in stipulated time of 10 days like in most of the pending cases of rape and custodial killings. Massive protest was held across the valley against the incident. To keep up its good image, the army on Monday December 27, said it has dismissed the trooper involved in the Sallar episode and sentenced him to one year rigorous imprisonment. The summary court martial and joint probe was completed within a week and the soldier was handed to the civil authorities for execution of the sentence in accordance with the provisions of law, he said.

However, Srinagar based defense spokesman said the medical examination of Hakim Jan and the inquiry ordered by the army proved that the allegations of rape were baseless.

STUDENT KILLED AND WOMAN DIED
Dec 19: Unidentified gunmen on Friday December 17, night kidnapped Manzoor Ahmad Wani s/o Ghulam Hassan from his house at Kanpar, Chadoora and shot him dead later. Police found his bullet-riddled body in the morning of December 18. The deceased was a student. Meanwhile, a woman identified as Khatija wife of Ghulam Muhammad Bhat died of a cardiac arrest when the troopers of 143 battalion launched house to house searches in Rampora, Krangsoo Mattan in Islamabad district. Her death created panic in the area.

WOMAN ‘RAPED, KILLED’BY FORCES
Dec 20: In Bhalesa village of Doda troops of 26 Rashtriya Rifles (RR) allegedly raped Sara Begum w/o Mohammad Din on December 14 and killed her subsequently. The alleged victim was a resident of Tanta, Bhalesa in Doda and troops allegedly fired upon her after committing rape in the adjoining forest area.

TWO SKELETON RECOVERED IN GOOL
Dec 19: Police recovered two skeletons from Choken Bella Gool heights of Udhampur district which were identified by their family members with the help of the clothes. The skeletons were identified as of Abdul Rehman s/o Jamal Din Hajam and Abdul Aziz s/o Muhammad Wani both were the residents of Sarunda Gool. Unidentified persons abducted the deceased, according to police on Dec 24, 2003.

SHARP RISE IN SUICIDES AMONG SECURITY FORCES IN J&K
Dec 21: As many as 9524 persons including security forces and militants have been killed in Jammu and Kashmir between 1st January 1998 and 30th September, 2001, Rajya Sabha was informed. Quoting the state government, Minister of State for Home Affairs Vidia Sagar Rao said in a written reply that 3166 civilians, 1382 security forces personnel and 4976 militants were killed during the said period. Rao said a total of 770 persons including 513 militants, 112 security forces personnel and 145 civilians were killed in the state after September 11 attack on US. Nearly 600 BSF personnel, including 32 officers, have died in Kashmir since militancy started in the state in 1989, IG, BSF, Naresh Mehra, told reporters last year.

The Jammu and Kashmir police have lost 69 officers and 334 personnel from other ranks in the violence during the past decade. They include one SP, 14 Dy.SP’s, 14 inspectors, 16 sub-inspectors and 24 assistant sub-inspectors. Nearly 1575 army men have been killed in four years; the Defence Minister Pranab Mukherjee stated this during question hour in the parliament. The Indian army has lost 102 officers, 118 junior commissioned officers and 1355 other ranks from January 1, 2001 to Nov 30, 2004.

THREE PERSONS HELD
Srinagar, Dec 22: Troops reportedly took three persons into their custody. The arrestees were identified as Abdul Rashid Dar s/o Abdul Hamid Dar of Sombora, Pulwama, Ghulam Mohi –u-Din Dar of Zoohama and Manzoor Ahmad Bhat of Chadoora.

‘FAKE SURRENDER’ ACCUSED GRANTED BAIL
Srinagar, Dec 23: Chief Judicial Magistrate, Budgam has granted bail to the three persons including the kingpin of the fake surrender drama.According to reporters the trios were released on bail after the CJM heard the arguments of the lawyers.

One of the accused had been arrested in a raid from Rajbagh area on December 16 for stage-managing the fake surrender drama of about forty persons with most of them being civilians, in lieu of providing them with employment. The arrested person Nazir Ahmad Bhat, kingpin of the gang also happens to be a close relative of Peerzada Mohammad Sayeed, Congress President in the state. Master Mohammad Malla, one of the accused had surrendered before the police while Bashir Ahmad Goli was arrested and lodged in the Central Jail.

ONE DISAPPEARS, HOUSE BLASTED IN TRAL
Srinagar, Dec 23: The troopers’ allegedly subjected one person to custodial disappearance after an encounter in Tral. Sources from Tral said, the troopers allegedly fired motor shells on the house of Khazir Mohammad Wani in Naka Pathri and arrested his two sons Fayaz Ahmad Wani and Ali Mohammad Wani after an encounter with the militants. While the troopers have registered a case against Fayaz and claimed to have recovered arms from his possession, however, the fate of his brother is not known.

SHRC OFFICE TO OPEN IN JAMMU
Srinagar, Dec 24: The Jammu and Kashmir State Human Rights Commission will start functioning at Jammu in its sub-office (House No. 6/A) in Gandhinagar, Jammu from Jan 3, 2005.Justice A M Mir, Chairman SHRC would meet individuals, delegations and organizations of Jammu province, the SHRC said in statement.

Srinagar, Dec 25: A mentally challenged person was allegedly shot dead by the personnel of BSF of 173 Battalion in Sherabad, Tral. The deceased has been identified as Shamshad Ahmad Ganai s/o Muhammad Shaban Ganai of Poshwan, Tral.

ARMY PUNISHES SOLDIER FOR MISCONDUCT
Srinagar, Dec 28: The army has dismissed non-commissioned officer Lance Havildar Krishna Bahadur awarding him one year rigorous imprisonment for “misbehaving” with a 60 year old woman Haqeem Jan of Salar Pahalgam on Dec 20.

According to a defence communiqué, the army while taking serious note of the act of misconduct by the soldier tried him in a Court Martial under army law. “The soldier has been dismissed from service and awarded one year rigorous imprisonment,” the communiqué said adding the soldier would be handed over to police at Central jail Jammu for the execution of sentence.

POLICE REPORT RAPS RAPE ACCUSED
Srinagar, Dec: 29: Police has sent its investigation report on the Handwara rape incident, to the government. Quoting police sources said complete report on the rape incident of a ten-year-old girl and her mother, filed by the police has enough substantial evidences to prove the accused army major guilty of the crime.
    Police in it has confirmed that the major of 30 RR raped the mother and her daughter at their residence, during the intervening night of Nov, 6 and 7. The accused, in the report has been proven guilty under the charges which include 354 (outraging modesty), 451 (unauthorized access into house), 323 (thrashing), 504 (threatening), 344 (keeping hostage) and 376(rapes).
However, quoting a senior police official, the police report would not be submitted before the general court martial but to the court of law adding that police was waiting for government orders to submit challan before the court

ARMY USES CIVILIANS AS IN DODA
SRINAGAR, Dec 29:
Army has been accused of using civilians as human shield in Doda district.
According to reports, one Jalal Din s/o Abdullah Khan a resident of village Mangmil Doda on Sunday December 26 was admitted to district Hospital Doda after he received bullet injuries in an encounter in the same village where he was allegedly used as human shield by army personnel.
The villagers alleged that army was forcing the locals to accompany them during search operations in the area. They said army picked up Jalal Din and asked him to accompany them to a nearby village.On reaching the destination, villagers said, firing started during which Jalal received bullet injury.

WOMEN BEATEN IN PULWAMA
Srinagar, Dec 31: Many women protesters were injured when police beat them up with bamboo canes at Babahar Pulwama .The women, and many hundred men were protesting against the killing of mother-daughter duo.
