Editorial                RHETORIC AND REALITY

      On completion of two years rule by the coalition government led by Mufti Sayed, the government has highlighted it’s achievements in the local and national dailies like accomplishing major projects, flyovers, bridges, schools, water supply schemes and promoting tourism. The government through the advertisements has tried to camouflage the situation in Kashmir. It is nothing new. It has become customary with every government who has governed the state (governor rule or civilian), to claim that the normalcy is returning to the valley; people are fed up with militancy, tourism is improving and people are yearning for peace and tranquillity.

      The Mufti regime is doing the same what its predecessor Farooq Abdullah’s regime did after he governed the state in 1996 but unlike, the Farooq Abdullah’s regime the present regime had issued a declaration called as Common Minimum Programme (CMP) released on October 2002.  The main focus in the CMP was on human rights situation in Kashmir which is the major issue confronting everybody. In the CMP the government promised to review all cases of detenues being held without trial for longer period. Though the government initiated the process but it was scuttled by the opposition and even by its coalition partner Congress from the pressure of right wing Bhartiya Janta Party (BJP) which wanted to take the political mileage during state elections.

     The government’s decision to review the draconian laws and its commitment to ensure instituting careful and transparent pre-screening and monitoring procedures, so that the laws are used sparingly, has not been done. These laws are intact and are still used arbitrarily, particularly the Armed Forces (Special Powers) Act. As promised there has been no investigation in the human rights violations. Neither culpable have been punished. Since the new regime took over there have been 141 cases of enforced or involuntary disappearances, 78 cases of extra judicial executions and custodial killings, 4 reported cases of rapes and 78 enquiries ordered out of which only four enquiries have been completed but no one has been punished yet. Even in the enquiries there has been no transparency.

     Notwithstanding, the repeated requests made by the State Human Rights Commission (SHRC) for providing more powers or even doing the needful under the present statute like providing them the independent police agency to investigate the cases or offices at Jammu has not been heeded, not to speak of strengthening SHRC, which is fast losing the hopes and expectations from the victims since it was constituted. Even the recommendations made by the SHRC are pending before the government for years together without taking any decisions. The other commitments made in the CMP like raising of the ex gratia relief from 1 lakh to 2 lakh or rehabilitating the militancy victims, orphans, or providing education to the orphans of militants are yet to take off. The only credit, which goes to the government, is repealing the Prevention of Terrorism Act (POTA), which effects only 64 persons and has been repealed because there was a powerful campaign against it all over India. The Public Safety Act (PSA) is still being used to detain the political dissidents. The detenues have been incarcerated and booked under other detention orders even if the detention has been revoked by the High Court.

     It is otherwise unrealistic to expect that in any civilian government, the state is going to make any difference as far the human rights situation is concerned for the reasons that the “law and order” is being taken care by the Unified High Command of which the Chief Minter is the nominal head de facto. The same is being managed by the federal government. How can a Chief Minister make a difference when he has no control over half a million military and para-military forces whom he cannot even punish, transfer or conduct investigation against their maleficent deeds, as it falls in the central jurisdiction. Whenever the president of the People’s Democratic Party has publicly assailed the army for violating human rights, the same had to accept the criticism from some politicians from Jammu that Kashmir is a part of India not because of politicians but because of the army. It has strengthened the view point of people here that any government ruling the state doesn’t feel accountable to people. The ruling part in the J&K is not because of people but because of center. No politician has a moral courage to step down from power making human right an issue.


DAUGHTER MOTHER RAPE; INVOKES STRONG PROTEST

    Ten-year-old Shabnum Rashid and her mother Aashia Begum 29, w/o Abdul Rashid Dar at Baderpayeen village of Handwara on the night of November 4 were raped by the troopers of 31 Rashtriya Rifles (RR). This incident sparked widespread protest in the entire area. People over six thousands went on streets block Baramulla – Handwara highway for hours. The protesters in unison chanted slogans against the troops alleging rape of the mother daughter duo by them.

    The incident received widespread condemnation from all sections and political parties irrespective of their ideological differences. Dr. Shubeena of sub district hospital Handwara confirmed the forcible act of rape after medically examining the victims. She also found bruises and other marks of physical violence on the minor Shabnum’s body. The marks of semen were found on bodies and trousers of both. A team of doctors is likely to submit a detailed report to the authorities. In FIR it has been stated that on November 6, Major Rehman (fake-name) and his accomplices after raping mother daughter duo also attempted to molest other women who were busy in rice husking. A complaint has also been filed to SP who further directed Dy.S.P for immediate action and submission of investigative report within 10 days. In the preliminary investigation, it was found that Aaisha and Shabnum were raped and other women molested.

    In Srinagar, defence spokesperson Colonel Batra denied the allegation but said army has ordered inquiry into the incident. In his version, Colonel Batra said “On Saturday gunmen fired upon Shalpora police station. The police personnel of the police station rang up 7 RR for help. 7 RR conveyed message to 30 RR who deputed a patrolling party. But when 30 RR was on its way to police station, they were informed by their source that the militant who fired upon police station have fled away. The source told the patrolling party to search the house of Abdul Rashid Dar because militants were frequently taking shelter in his house. The army searched his home and came out”.

    He said medical examination of the mother and daughter has been conducted and army is waiting for report. “Prima facie nothing has happened”, he said. Talking to the media persons, spokesperson kilo Force said, “Maj. Gen. Balharra of Kilo Force visited the village and personally met the alleged rape victims and also elders of the area to ascertain the factual position. Subsequently, he appointed Colonel Nandlal as enquiry officer and sought the services of a Dy SP, from local administration to assist the enquiry officer and ensure transparency and impartiality in the investigations”. Besides, he said, a Special Investigation Team (SIT) headed by Dy SP, who will be assisted by SHO Handwara and other police officials has been constituted to investigate the case. Meanwhile according to Divisional Commissioner Kashmir, Khurshid Ahmed Ganai the government has taken immediate action on the allegation. The government, he said, has appointed Sharafat Ali Khan additional Deputy Commissioner as enquiry officer who has been advised to conduct magisterial probe into these allegations and ordered him to report the real facts of the case to government through Deputy Commissioner, Kupwara within 10 days time. Recently, Army Chief NC Vij has ordered an inquiry into the incident and a report to be submitted within 10 days time. On November 9 the government ordered DNA test and finger printing so as to reach to the culprits.

    A team of PCHR accompanied by some lawyers of Handwara Bar Association visited the village after four days of incident. Talking to PCHR team Aisha seeking justice for herself and her daughter and categorically rejected any type of compensation, if offered. “Major should be brought before me in chains and his uniform should be snatched from him”, she said. Meanwhile Police has registered FIR against the Major and he has been removed from the army camp.

    On November 10, the Jammu Kashmir High Court Bar Association has demanded arrest of army Major for raping a woman and her minor daughter at Handwara last week. A team of the Bar led by Muhammad Ashraf Thakur comprising Reyaz Khan, Sajjad and Rizvi, advocates, visited Bader Payeen village and called on the victims. The Bar accused the police of harassing the locals. “The police especially the SHO Kralgund have made life hell for the people of the helpless village. He has effected scores of arrest most probably to please Mehbooba Mufti who was greeted with anti-India and pro-freedom slogans on her arrival in the village”, a spokesman of the Bar said.

    “When one Muhammad Sultan Shah went to the police Station to seek release of the arrested persons, the SHO kicked him in the abdomen causing severe internal injury to him. He was taken to hospital in critical condition”, added the Bar spokesman. The spokesman said the government had deployed hundreds of policemen in the village to prevent demonstrations. “The police must be removed from the area and Aisha’s husband released immediately along with other arrestees”, the Bar demanded. On November 13, army claimed of placing the Major allegedly responsible for the Handwara rape under suspension.
 


JKCCS ORGANISES DEBATE ON NATIONAL HEROES

Srinagar, Nov 26: The Jammu and Kashmir Coalition of Civil Society (JKCCS) organized a debate on national heroes at Broadway Hotel Srinagar on November 27. The whole programme was divided into two sessions. The first session constituted a debate on national heroes with Chief Guest Mohammad Yaqoob Rafiqui, the grandson of Abdul Salaam Rafiqui (who was exiled from Kashmir to Indonesia by the British regime for his revolutionary and freedom loving attitude in 1896). Rich tributes were paid to Abdul Salaam Rafiqui and the speakers gave the account of his contribution to the audience. The prominent persons among others who were present included Noor-ul-Hassan former chief conservator forests, Ved Bhasin chairman Kashmir Times group of publications, Advocate Ghulam Nabi Hagroo and Gautam Navlakha, a New Delhi based journalist and prominent human rights activist. Talking in unison all the speakers termed the distortion of history as a “weapon of suppression”.

Underlining the need to retrieve the national heroes of Kashmir Ved Bhasin pointed out that the common masses have been fed upon the history compiled by the governments “so as to serve their political ends”.
“There is state history and there is people’s history. Whom the government may declare as the hero could be a traitor in the eyes of the masses”, asserted Hagroo.Bhasin in his brief observation emphasized the need to re-write the Kashmir history in the people’s perspective to safeguard against the obliteration of history, which is the most potent weapon of the colonists”.

    The debate was triggered by the JKCCS initiative to retrieve the noble and revolutionary souls from the depths of oblivion and accord them the due honour. The group had last year remembered Subhan Hajam as the national hero of Kashmir for his crusade against the state sponsored prostitution.

Muhammad Yaqoob Rafiqui, grandson of Abdul Salaam Rafiqui - this year’s national hero as per the JKCCS reckoning took the audience by awe when he gave out a brief resume of his grandfather. Knowing that Abdul Salaam had been a born revolutionary who lived through his 30 - year exile. With the desire to utter his fellow Kashmiri’s from the yoke of the Dogra rule many a participant betrayed a sense of compunction. Not for the situation Kashmir has been undergoing over the centuries but for the irony that the real saviours of Kashmiris have been forsaken. The whole session followed with the turban tying of Muhammad Yaqoob Rafiqui as an honour to acknowledge Abdul Salaam Rafique’s contribution. The coronation of Mohammad Yaqoob Rafiqui was done by the CCS president Mr. Parvez Imroz, who in his welcome address said, “We want the present and future generations to know the real history and real heroes”.
    The second session constituted Robert Thorp award ceremony, which was posthumously honoured to Aasia Jeelani, a human rights activist who was killed in a landmine explosion in Lolab, Kupwara on 20th April 2004 during the election monitoring programme organised by JKCCS.

Speaking on the occasion, all the speakers including Parvez Imroz, Gautam Navlakha and Naila Neelofar stressed the need for women to understand themselves and come forward. Mughli Begum whose only son disappeared 14 years ago after he was taken into the custody presented the award to Aasia’s mother Jehan Ara Jeelani. On this occasion Aasia’s mother released a book “Aasia – the Martyr of Peace”. Later Dr. Snober, Aasia’s elder sister thanked JKCCS on behalf of her family members for honouring Aasia with the award. “We really feel honoured”. The lamp which Aasia has lit should be kindled”, she said.

    A documentary film “Aasia - A quest for justice” by Global Witness, (the media group working under the Jammu and Kashmir Coalition of Civil Society) was also screened in which a brief introduction of Aasia’s childhood, academic career, family life and her contributions towards highlighting the unheard voices. During the screening of the film sobs and sighs could be heard from all around in the hall. Aasia’s mother and sister could not contain their emotions. Two other women Parveena Ahanger (President of Association of Disappeared Persons) who is still seeking the whereabouts of her son and Mughli Begum were also overwhelmed over the occasion. Advocate Hafiz-ullah Mir who presented word of thanks. The CCS’s Vice President Zahir –ud-Din replied to the critical queries related to the whole programme.
 


EXTRA JUDICIAL EXECUTION OF A STUDENT SPARKS PROTEST

Srinagar, Nov 27: Rejecting the police claim of killing four Fidayeen militants in an encounter at Doodh Mohalla Shalimar the residents of the area alleged they were killed in fake encounter.The police in a statement said, an ambush by the joint posse of SOG and CRPF at Doodh Mohalla was laid on a tip off Fidayeen attack at the foreshore road Doodh Mohalla, Shalimar on the intervening night of 26th -27th November. According to police an auto rickshaw was asked to halt for the usual security check but the order was defied which lead to an encounter. Four militants comprising two locals and two Pakistani militants were killed in ensuing gun battle. The police further said, the militants were on a mission to carry suicidal attack on Hotel International at Sonawar and by killing them a major tragedy was averted.

    The deceased were later identified by Police as Ali Muhammad Kamran r/o Pakistan, Abdur Rashid Baloch of Pakistan, Zahoor Ahmad Najar s/o Farooq Ahmad Najar of Botyar Ghat- an active Lashker-e-Toiba associate who had been absconding since four years and Tazeem-ul-Haq of Kupwara.

In this connection Chief Minister, Mufti Mohammad Sayed on November 27, in a press conference applauded state police for averting a major tragedy. As the news of one of the deceased Tazeem’s death reached his native village, people in thousands came out on streets and protested against the killing. The locals alleged that Tazeem was an innocent youth not even remotely connected with any political or militant outfit. An interaction with the relatives revealed the hollow claim of government putting yet another question mark on the manner of extra judicial execution by the security agencies and how the security agencies are patronized by the state administration including the Chief Minister himself.

    Ten days later, The Informative Missive team went to the area to access the situation. The village very close to the national highway presents a dismal look. One could hear the moans of wailing women and anguish screams of the villagers. Entering Tazeem’s house all seemed deserted and distressed. Tazeem’s father Ghulam Rasool War who initially braved the situation by controlling the protest seemed to be in a state of great trauma. Since the incident took place, different political activists visited the family. Even on the day when the team of Informative Missive visited, a prominent Jamaat-e-Islami leader had come to condole the family.

    Talking to The Informative Missive, War a member of Jamaat-e-Islami said, “For two days, I was in Ashpora – a remote part of Handwara tehsil, in connection with social activities organized by Jamaat-e-Islami. On 27th November morning as I returned home, my father-in-law came to condole my daughter’s death who died on 6th June this year. He could not come earlier due to ill health”. As the family was about to take lunch, a constable from the local Police Station came and asked Mr. War to accompany him to the station as S.H.O had called him. Being a prominent figure in the area, War used to be called by army and local administration on various occasions.

    En route police station, a native villager informed Ghulam Rasool about Tazeem’s death which he said to have heard in a news bulletin from Radio Kashmir. It came as shock for Mr. War and he decided against going to the police station. Soon the news spread and the people began to assemble in the War’s household. On 28th November Tazeem’s half naked body, bearing visible torture marks was brought to the Chogul hospital. Protesting, people refused to bury the body demanding that Mufti Sayed should apologize for branding Tazeem as militant. Talking to The Informative Missive Tazeem’s friend said that he was friendly and happy go lucky guy. “We were preparing for exams and Tazeem had already appeared in economics paper. But see what has been done to him. Is this how the Indians think they will bring Kashmiri youth into their national mainstream?”

    As the local administration tried to intervene they could not persuade the people to bury Tazeem and it was finally on Monday (November 29th) that Tazeem was buried in his native village of Kulangam Handwara. The District Development Commissioner Kupwara Abdul Majid Khanday has asked sub divisional magistrate Handwara to inquire whether Tazeem was a militant or not and to inquire about his college and other activities. The SDM has been further directed to collect inputs and report would be sent to the Government.

    “The government is embarrassed and is trying to justify the killing of my son somehow. See the report in this newspaper; said Tazeem’s father pointing towards a local daily Wadi Ki Awaz dated 30th November, headlined “Tazeem Was A Militant: Police”. Now my son has been allegedly involved in a grenade-throwing incident according to this report, how sick of them. It is like rubbing salt on wounds. My son was injured along with others in a grenade blast in Handwara some months back. Police itself took him to hospital for treatment and now the same police are alleging him to be a militant. If this was the case then why did not the police arrest him earlier if they knew he was militant? How can a known militant be allowed to attend regular classes in the local college, play cricket and live a normal life?”Replying to our question of what was Tazeem doing in Shalimar area on that day, his brother replied, “His exams were near, so he had to fetch guess papers and my examination form for me from the University. He left the house at four o’clock on Friday and would have probably stayed with our cousin near the University. We were expecting him back on Saturday as he had to play a cricket match on Sunday”.

    It is likely that he was arrested in the vicinity of the university as he might had reached in dark hours in the evening and subsequently killed at foreshore road.

    “The government should accept the moral responsibility of killing my son and probe the actual circumstances in which he was killed and punish the perpetrators for this heinous crime”, demanded his father.


PROTESTORS KILLED AND DOZENS INJURED IN AN UNWARRANTED FIRING BY FORCES

Budgam, Nov 29: Two persons were killed and dozens injured on November 29 at Chatroo Dangerpora in Budgam district as people protesting against forces harassment during a search operation were fired upon unwarrantedly.

    According to police on a tip off two militants hiding in a house where a marriage ceremony was taking place, RR troops cordoned off the village to hunt for the militants. While preparing to search the house an altercation broke out between some villagers and the troops. Some villagers hurled Kangris (fire pots) on the troops. In retaliation troops fired back killing two persons and injuring one.

    The Informative Missive reporter visited the village a few days after the incident and interacted with the villagers about the incident. Located just near the periphery of the Kashmir airport, it is quite likely that the villagers identify themselves with the slogan of peace and change, as they are the first to witness the Planeloads of tourists and ministers coming from New Delhi. The incident took place during a search operation in the village, at the time when peace is the key word and on the agenda of India and Pakistan talks. The brave soldiers of India often attributed with heroism and bravery by Indian films opened their guns on unarmed civilians.

    First, the team visited the house of Farooq Ahmed Wani who was among the unfortunate two killed in firing on that day. His father Abdul Majeed Wani narrating the woeful incident said, “It was Monday morning when we were getting ready for our daily chores. The announcement for crackdown was made from a local mosque. It was the 35 RR of Choon camp Budgam. Despite the fact that 7:00 am is quite early and cold in last days of November, we had witnessed two such search operations in the previous month of Ramadan, this seemed a similar one. All the male folk of the village irrespective of being young or old were made to assemble in the field outside the village. We were made to sit on the damp fields for hours together. We observed that the army personnel were neither searching the houses nor asking us anything else. We persuaded the village head Abdul Gani Wani to talk to the officer-in-charge to allow the elderly persons to go home to take tea as they were shivering with cold. This request somehow did not please the officer, who reacted by kicking and abusing the village head in front of us. Some villagers reacted by hooting at the officer and someone threw a mudstone towards the soldiers. This provocation was enough for the soldiers to open the barrels of their guns on us. The firing continued for about ten minutes. We could not even run for our lives, and had no option but to lie down in the field to save ourselves. After they stopped firing, they ran amuck and beat us with rifle butts and kangris, kicking and assaulting the already injured and frightened lots.

    A boy lying near Farooq, noticed him bleeding profusely and he cried hysterically. Soon it was observed that apart from Farooq, Ghulam Hassan Mugloo, 50, s/o Ghulam Ahmed Mugloo and Ismail Wani, 65, were also bleeding profusely. These three were quite serious among the scores injured by the firing and subsequent beating. In the meantime, CO of the RR reached the spot. He allowed the seriously injured to be shifted to the hospital. I accompanied by my wife and other family members took my son to Chadoora hospital, where from they referred my son to SKIMS, Soura hospital and he died soon after we reached there”.

    The Informative Missive reporter also visited the house of Ghulam Hassan Mugloo, the other person killed in the firing. His son Abdul Hameed was still in a state of shock and did not respond to our queries. His wife, one son and two unmarried daughters survive him. He worked as a watchman at the airport. Hassan’s elder brother narrated the incident, in the same way as Abdul Majeed had said and added, “We were not even provided with a vehicle by the army to move my brother to the hospital, even before the firing, we had requested the officer to permit a pregnant lady to be taken to the hospital in a civilian vehicle. The permission for the vehicle was not granted and the lady had to manage to walk up to Panzen, which is a distance of two kilometres from the village. We lifted Hassan on our arms up to Panzen. Thereafter, we shifted him in a police vehicle to Budgam hospital. They referred him to Bone & Joint Hospital and from there he was referred to SMHS hospital. He battled for life for some hours and was given blood transfusion. But after some hours he gave up and died”.

    Ismail Wani, an old man who was also shifted to hospital was saved. His eye was badly damaged with some thing he could not recall. While talking to The Informative Missive he said, “something sharp slit my left shoulder, I felt severe pain soon after there was heavy blow on my eye and I cannot recall what happened after that. I regained senses in the hospital. Interestingly, he was not deemed fit for compensation by the administration, he showed his badly bruised shoulder tore by a bullet and also had stitches on his left eye and forehead.

    The relatives of the killed demanded a court of inquiry to be set up to probe the unprovoked firing. On being asked that despite the fact that they had received an ex-gratia relief of one lakh rupees as compensation, do they still demand a probe into the incident, Farooq’s father replied, “One lakh cannot be a compensation for a life of youth. They can take the money back if they feel it is an exchange for justice”. Hassan’s relatives echoed same sentiments. The villagers still have fear psychosis after five days of the incident and relatives from other villages are pouring in to inquire their well being.
According to an official spokesman, the minister of State for Home, A.R. Veeri visited the village and conveyed his personal condolences to the bereaved families. “Expressing sympathies with the families over the shocking incident, Veeri said that this is an unfortunate incident and ordered on the spot magisterial probe,”the spokesman said. He further said, “Action would be taken against guilty.” The minister, according to the spokesman, handed over ex-gratia relief cheques of Rs. 1 lakh each to the two bereaved families and announced that one family member of each family would be provided with government job.
 


MILITANTS BEHEAD A GOVERNMENT GUNMAN

    Militants dropped the head of a government sponsored gunman in Batamaloo bus stand on Saturday November 20, afternoon creating panic in the area. Traffic was suspended for sometime as panic-stricken-people limbed the roofs of buses and nearby buildings to have a glimpse of the head. Police took the head into custody half-an-hour after it was dropped there. Police later ascertained the head belonged to a government-sponsored gunman, Farooq Ahmad Bhat s/o Wali Mohammad Bhat of Suzeith, Narabal in Budgam district. Militants had killed him and five others on the night of November 16. They had severed his head and taken it along.

    While talking to the reporter of The Informative Missive Narabal residents revealed the whole incident. According to the residents Farooq Ahmed Bhat, a counter insurgent was very active in the area and used to harass people of and on. This included extortion, killings and molestation. On the day of incident, Farooq survived by his wife and three children had gone to invite his sister in Kawoosa, Budgam for his second marriage, which was scheduled on November 17. At around 9:30 pm, when the family was about to take tea, Muhammad Yousuf, a Hizbul Mujahideen (HM) activist of Rothsun Budgam entered the house of Bashir Ahmed brother-in-law of Farooq along with his two associates. Entering, Yousuf asked the family members to hands up, however, Farooq reacted immediately shooting aimlessly. The bullet hit the gas mantle turning it off. Yousuf retaliated killing all four in the crossfire.

    According to the sources, Yousuf intended to target only Farooq Ahmed, but as Farooq reacted immediately, in the ensuing encounter four other innocent persons lost their lives. Yousuf then entered into the kitchen where Farooq’s sister and her brother-in-law were preparing meals for them and asked for knife and an axe. Afraid, they handed over the tool to them with which Yousuf beheaded Farooq. Thereafter, he left the body on the spot and displayed Farooq’s head before villagers of, Rathsun, Wuhangham and Sunoor in Budgam district. Yousuf took Farooq’s head and displayed it before his mother as a success symbol for his revenge and then dropped at Batamaloo, which created panic in entire area.

    Talking to The Informative Missive, Yousuf’s relatives said that Mohammad Yousuf killed Farooq to avenge the death of his brother and brother-in-law and harassment meted out to his mother by Farooq, who also burnt down their house sometimes back. Farooq Ahmed, a prominent counter-insurgent of the area had several cases of killing and threatening people against him, which includes killing of militant Mohammad Yousuf’s relatives.

    The other people killed in the encounter are Mehraj-ud-Din who was accomplice of Farooq, Bashir Ahmed brother-in-law of Farooq, Mehtaba mother of Bashir Ahmed and Fayaz Ahmed a neighbour, who was present in Bashir’s house at that time. Two days after the Farooq’s killing, counter-insurgents barged into the house of one Abdul Rehman Hajam neighbour of Yousuf in Kawoosa and tried to kidnap him. They charged him of informing militant Yousuf about the presence of Farooq in Bashir Ahmad’s house. Abdul Rehman’s family resisted the kidnapping attempt of counter-insurgents, who retaliated by burning down Abdul Rehman’s house in which all his property was gutted down.

    It is worth to mention here that Zareefa, who was going to tie nuptial knot to Farooq the very next day was also shot dead when Farooq was killed. Zareefa was herself an active Ikhwani activist and widow of one Ikhwani Fayaz Ahmed Khan. It is believed that same people who killed Farooq had killed her as well.
 


WOMAN RAPED BY RR MEN IN MATTAN

On 4th November 2004, A woman was allegedly gang raped by an Indian army Subedar and his bodyguards of 7 Rashtriya Rifles (RR) in Soonchbrah, Mattan area of South Kashmir. The victim was identified as Parveena, 18, w/o Ershad Ahmad Khan of Gujjar (nomad) community. The incident surfaced after the villagers held massive demonstrations in front of Mattan police station, demanding rapid stern action against the involved soldiers.

    The protesters also accused the RR soldiers of harassing the victim and her family. They also alleged that the troops were forcing the family to retract from their statements.Following the massive protest, the Deputy Commissioner Islamabad ordered a probe into the gang rape incident. The police have filed FIR 534/2004 under section 376, 450, 342 RPC. The clothes of the woman have been sent for forensic test to F.S.L. The SHO concerned and the additional SP Anantnag took up the matter with senior civil and police officials. Police is awaiting the report to conduct further investigation.

    Meanwhile, the mother-in-law of the victim has contested the news report in a local daily Al-Safa in which it has been said that the Army has compensated the victim. The mother-in-law is reported to have said, that they want justice and not any compensation.The State Human Rights Commission (SHRC) has also taken cognizance of the incident. Describing the incident as shameful, the Chairman of the SHRC said the matter will be taken up with Chief Minister and SHRC will recommend stringent punishment for the guilty soldiers. The SHRC has directed the IGP to investigate and file a detailed report into the matter before end of this month. The case has been listed for November 22.

    The Chief Minister, Mufti Mohammad Sayed categorically rejected the incident as a false allegation and gave a clean chit to the accused while addressing the media in Srinagar. The Indian Home Minter Shivraj Patil was also present at the press conference.


RELATIVES OF DISAPPEARED VENT IRE ON ICRC

    On November 25th the Association of Parents of Disappeared Persons (APDP) accused the International Committee of Red Cross (ICRC) for maintaining a “meaningful silence” on the custodial disappearances in Kashmir. “ICRC’s Kashmir chapter has adopted a silence over the human rights violations in the state. It has been barred from visiting any detention centre where the innocent persons have been illegally confined nor can it investigate the cases of custodial disappearance,” patron APDP, Parvez Imroz told reporters at the sit-in of the families of disappeared persons which they organize on 25th of every month at Sher-e-Kashmir Municipal Park.

    “ICRC has made a secret deal with the Indian government that it will only visit the prisoners in the jails and nothing more than it. The APDP strongly condemn the working of ICRC in Kashmir”, APDP Patron told to reporters. Talking to the media persons, Imroz said that the presence of the ICRC in the state has only benefited the successive regimes and the woes of the victims have been left unheard. Despite the presence of the ICRC in the state, more than ten thousand people have been subjected to custodial disappearance as per Imroz.

    Adding further Parvez Imroz said, “ICRC has access to the unlawful detention centres or other places where the detenues are incarcerated, tortured while most of them get disappeared. The ICRC has no mandate to probe into the enforced disappearances unlike other places. They have no mandate to meet the victims of torture, extra judicial executions (EJE) or custodial deaths”. Rejecting the claims of the state police that some disappeared persons have returned to their homes and others killed in encounters, as farce, he said, the families have not received any information regarding them. ”Neither they came to homes nor did the security forces return their bodies”, said APDP Patron Mr. Parvez.

    Stating the law enforcing agencies were still subjecting Kashmiris to custodial disappearance, Imroz cited example of a person who was recently arrested outside the session court in Budgam and shifted to some unknown destination. Dozens of families of the disappeared persons participated in the sit-in, to know about the development in their cases. All of them had a tale of woe to share. On the occasion the families of the disappeared persons vowed to continue their struggle till they come to know about the fate of the disappeared persons.


SHRC RECEIVES 575 COMPLAINTS OF HR ABUSES IN 2004

    According to the figures released by the State Human Rights Commission (SHRC) the SHRC has received 575 complaints of human rights abuses in 2003-2004. Statistics available with SHRC reveal that the complaints include cases of 23 death compensation, 14 compassionate appointments, 41 ex gratia relief, 46 harassment, 15 custodial deaths, 27 disappearances, 4 murders, 1 kidnapping, 2 rapes, 7 service matters and 1 sodomy. From April 2004 to September 28, 2004 the commission received 240 cases of which 190 had been disposed off. In 2002-03, SHRC received 482 complaints which include 28 death compensation, 28 investigation/enquiry, 14 compassionate appointments, 146 ex-gratia relief, 50 harassment, 12 custodial deaths, 73 disappearances, 40 releases, 12 murder and three rapes.Chairman SHRC Retd. Justice Ali Mohammad Mir said that they have received almost same complaints over the last three years.

    “But there are varied reasons for that. First the people have reposed faith in SHRC and they are coming and registering their complaints. Second there is a lot of awareness created by the commission and that is also the reason that more people come to lodge their complaints. Chief Minister, Mufti Mohammed Sayed on the completion of two years in office had said that there is visible change in the human rights situation. Human rights activist Parvez Imroz, however, countered the government’s view saying that there is no improvement in the human rights violations in Kashmir. “We could realize that stopping the human rights violation altogether is not in the hands of state government because armed forces and para military forces don’t come under their control. But at least we were expecting accountability from this government which is missing”, said Imroz. He added that the government ordered probe into 52 cases but the findings were not made public. Imroz added that they are planning to issue a counter balance sheet of the human rights violations that have been committed during the last two years of the government.


GOVT DISOBEYS SHRC RECOMMENDATION IN CIVILIAN’S DEATH

Srinagar, Nov 6: Although the State Human Rights Commission has recommended an ex-gratia relief of one lakh rupees and a job to the next of kin of a civilian Bahar Ahmad Malla of Baramulla district who was killed by the security forces seven years ago, his brother Manzoor still awaits justice.

    Bahar Ahmed, Manzoor said, was killed in a “fake encounter” by the security forces. According to him, some unidentified gunmen barged into his house on January 15, 1997 and asked for food. Next day, Army raided Shogpora village of Sopore and arrested the gunmen along with his brother from his house.
“January 28 was like a hell for our family. After 10 days search the decomposed body of Bahar was recovered from a nearby jungle. The bodies of other persons were burnt beyond recognition”, said Manzoor adding his brother was “actually” killed on January 17. “I identified him by his head. He was innocent and didn’t have any links with any militant outfit. I still don’t know why he was killed,” he added.
Manzoor said he could not pursue the case because of alleged threatening by the security forces. “I was not even allowed to register a case. The killers of Bahar threatened me of dire consequences”. However, the FIR no. 9/97 under section 307 RPC 7/25 obtained from SSP Baramulla notes, “Three to four unidentified terrorists got killed in a fierce encounter with army on the intervening night 17-18 January 1997. Some arms and ammunition was also recovered from the slain terrorists. The bodies couldn’t be identified because they were completely burnt. However, the skeleton was medically examined and handed over to Auqaf (Local Trust) for burial”.

    The report further notes “A person Manzoor Ahmad Malla has alleged that his brother namely Bahar Ahmad Malla was kidnapped by unidentified militants who were later arrested by the army camp Tragppora. The family members of the deceased have not informed the police station about the death of Bahar. It is evident from the case file that dead body remains unidentified as it is not established that Bahar Ahmed Malla is dead”.

    Manzoor, however, alleged the security forces in “collision with police hatched a conspiracy to claim that my brother was not among the killed. How can I believe them as I identified him from his half-burnt head and clothes. ”Manzoor had filed a case in the SHRC last year for seeking justice. The commission after cross-examining the witness and police reports found that Bahar was killed in custody. It also held that he had not ever participated or was involved in any militancy-related activity and recommended an ex-gratia of one lakh rupees and appointment to the next of the kin of the deceased under SRO 43.


DOWNSIZING OF ONE LAKH TROOPS IN J&K FROM DECEMBER

November 13: Following Prime Minister, Dr. Manmohan Singh’s announcement of reducing troops in Jammu and Kashmir, Directorate General of Military Operations (DGMO) prepared a roadmap and schedule of withdrawal of nearly one lakh troops. Estimates on the number of army troops in Kashmir vary from 3.5 lakhs to 6 lakhs, involving three Corps stationed in Jammu, Srinagar and Ladakh. Besides, Indian army have roughly 11 battalions along the Line of Actual Control (LOC) and four Rashtriya Rifles (RR) divisions under its operational control. Along the LOC, the army is likely to reduce the number of troops manning snowbound heights in Gurez and Kargil but not withdraw them altogether. In the Kargil sector, particularly, the thinning of troops is a sensitive matter because the 1999 war was the result of withdrawing troops from the heights in winters.

    The main objectives of the announcement to reduce troops are to demonstrate government’s sincerity in implementing confidence building measures. The Prime Minister had given an indication early in his tenure that he would like to reduce troops in Kashmir by the end of the year. “They haven’t been able to infiltrate in the same numbers as earlier due to our vigilance. The first phase of army reduction began from South Kashmir Anantnag district on November 17 with the de-induction of two formations. The first formation to be moved out was 5 para battalion of the army. 5 para located in Khanabal area in Anantnag district was part of one sector Rashtriya Rifles which is managing the counter insurgency operations in the South Kashmir districts of Anantnag and Pulwama. The troop withdrawal is expected to be 9000. On November 20, army de-inducted another batch of troops from Sunderbani sub-sector of Rajouri sector in Jammu.

In the second phase on November 22, army de-inducted around 1200 men of 3-Mahar regiment from active combat duties in Kashmir valley. The regiment was based in Uri sector for the last two years.


PIPFPD SAYS GOVERNMENT’S TRANSPARENCY EXPOSED

November 29: Denouncing the government of India’s decision of not granting travel documents to the members of the Pakistani chapter of Pakistan and India People’s Forum for Peace and Democracy (PIPFPD), a founder member of the forum and member of joint committee on Kashmir, Gautam Navlakha, said the move had exposed New Delhi’s policy of transparency vis-à-vis Kashmir.
“By controlling and restricting the access of our friends from Pakistan, the government of India has exposed, what it frequently called its policy of transparency”, Gautam accompanied by another forum member and Chairman of Kashmir Times group of publication, Ved Bhasin said while interacting with media persons.

    When asked what might be the reason behind the denial of the travel documents to the PIPFPD members, Gautam said the government of India was scared of allowing people to come and see the miserable plight of the Kashmiris. “They are scared now as the move to allow SAFMA members from Pakistan to Jammu and Kashmir backfired on them”, Gautam said. He added that India after finding it difficult to control the outcome of the journalists’ visit decided not to buy further embarrassment.
The forum, said Gautam had regretted denial of travel documents to the members of the joint committee on Kashmir.

    “Denying visa to people who played a pioneering role in promoting people to people contact between the two neighbouring countries speaks volumes about India’s commitment to promote such kind of exercise”, he said. The denial of visas to the members comes in wake of the ongoing visit of the South Asian Free Media Association (SAFMA) members to Pakistan and Pak pilgrims visit to Charar-e-Sharief, Gautam added.

    The main purpose of the visit to the state from December 25, according to Gautam was to interact and deliberate with the cross section of the society and to seek their opinion on the core issue of Kashmir, “The team comprising highly influential and credible personalities were scheduled to interact with separatists politicians, academicians, bar association, trade unions, civil society members, fruit growers, migrants and displaced people from border areas”, he said.

    Gautam, however, said the job, which the visiting delegation had to do would be now accompanied by the forum members of India. “By denying permission to the Pakistan member doesn’t mean that their job remains undone. The forum members will convey the aspirations of Kashmiri people to their friends in Pakistan”, Gautam added.

    According to Gautam, among the delegates the prominent personalities included Justice Majid Malik, former chairperson Human Rights Commission of Pakistan (HRCP), Afrasiyab Khattak, former finance minister and founder member of Pakistan Peoples Party (PPP) Bhutto group Pakistan Dr. Mubashir Hassan, director HRCP IA Rehman, leading counsellor of Pakistan and head Physicians against Nuclear bomb Dr. Haroon Ahmad and director Aurat Foundation Anees Haroon.

PATHRIBAL ACCUSED RESUMES DUTY

Jammu, Nov 5:
The Central Administrative Tribunal (CAT) has quashed the suspension of Farooq Khan one of the accused in the Pathribal massacre case. He submitted his joining report to the IGP Jammu where he was attached during his suspension.The CAT bench observed that in view of the provisions of All India Services (discipline and appeal) rules 1969, the initial period of suspension of Khan from July 29, 2003 was not reviewed and extended by an order that must be passed before expiry of the initial period of 90 days.

    So, the CAT noted that suspension of applicant shall be treated as revoked on expiry of 90 days and orders of Khan have to be treated as illegal and therefore quashed. The CAT observed that since no disciplinary proceedings had been initiated against Khan before the expiry of the initial 90 days and since the Central government had not approved continuation of suspension, the suspension of Khan was illegal and contrary to the provisions of All India services.

    The CAT bench further observed that in the present case respondents have not come out with any plea that any disciplinary proceedings were initiated against the applicant within the 90 days of his suspension.
The CAT bench said that the First Report as given by Justice S.R. Pandian as Commission of enquiry before the applicant was suspended had not found anything against the applicant and his earlier suspension was revoked. Even the progress report on investigation being conducted by the CBI in four FIR’s has not indicated involvement of the applicant in any such prejudicial activities which require his suspension or extension of his suspension from time to time.


OF 47 WHO SURRENDERED, 27 ARE NOT MILITANTS

Nagrota, November 9:
On November 9, 2004 – a group of 47 “militants” laid down their arms before Director General of J-K Police, Gopal Sharma and General Officer Commanding of Army’s 16 Corps Ashok Kapur at Nagrota in full media glare. Three weeks later, the J-K police found that 27 among these “surrendered militants” had nothing to do with militancy and were desperate unemployed men.

    They had been promised jobs by a local Congress activist and taken to Delhi. They ended up in the Army’s Nagrota camp where they posed as militants and lined up for the surrender ceremony. “They were not genuine militants. They were not eligible for surrender”, DGP Gopal Sharma told national daily The Indian Express. “We didn’t know then but later when we conducted their verification, they were found to be not genuine”. Sharma, however, said that all the men who surrendered at Nagrota were not fake militants”. There were genuine militants from Doda”, he said. “We are investigating the case. We are probing whether these people were duped into doing this. ”The army, however, insists all the 47 were militants, “it is all a cooked-up story, conceived by some disgruntled and anti-national elements”, said the spokesman of Army’s 16 Corps, Col R K Sen. “It was a big ceremony held in front of the media and the antecedents of each one of the militants had been verified before the ceremony.”

    Infact, the J-K police’s own intelligence unit in Budgam too had sent a detailed report about the issue. Interestingly, these ‘militants’ had hidden their faces at the media not to show their faces as they apprehended militant retribution. The investigation has also revealed that these men were having fake names as well as fake aliases before the surrender ceremony. ”Each one of them has been paid Rs 25000”, a source said.

    The seven men are traumatized, even scared to step out of their homes. All have a harrowing story to tell, of “false inducements” by a local Congress activist, solitary confinement and detention in New Delhi and Udhampur for months before being lined up for an official surrender ceremony by the Army on November 9. But, however, according to reports 27 of 47 “militants” shown as surrendering in Nagrota were, in fact, desperate unemployed men. While as J-K Director General of Police Gopal Sharma confirmed that they were not genuine militants, not eligible for surrender”.The J-K police has already informed Chief Minister, Mufti Mohammad Sayeed and top Army officers about the fake Surrender.

    On Dec 8, Pradesh Congress Committee (PCC) Peerzada Mohammad Sayeed has demanded probe into fake surrender of 27 persons from Charar-e-Sharief and Chadoora areas, in which his brother–in–law is the main accused. In the statement issued, he said all those found guilty should be punished as per the law. He said Congress has always stood for rights of citizens and political affiliation should not be a constraint to persecute the accused.

YOUTH’S DEATH IN ARMY FIRING
Poonch, Nov 27:
Superintendent of Police (SP) Poonch placed under suspension Station House Officer (SHO) of Gursai police station for not handling the situation properly in which one civilian was killed and another injured in army firing.Sub Divisional Magistrate (SDM) Mendhar has been deputed to conduct a probe into the whole episode.

    SP Poonch Mukesh Singh placed under suspension SHO Gursai police station Muhammad Amin Shah for his failure to handle the situation aroused due to army firing.It is pertinent to mention here that a civilian Muneer Hussain of Sagiot died on the spot while another Shahzad Ali of Sangiot sustained injuries when army fired on the protesters at Gursai. The protesters hailing from Bhatta Durrian who staged protest against thrashing of two Rehber-e-Taleem (ReT) teachers Zaif Ali and Showkat Ali by the troops at Sangiot during the intervening night of August 25-26, 2004. The demonstrators alleging harassment by the army and police who are conducting frequent raids in the villages falling under the jurisdiction of police station Gursai. The demonstration resulted into blockade of road at Bhatta Durrian. In the traffic blockade an army gypsy carrying a Major and his bodyguards were also entrapped. The Major asked the protesters to provide way to his vehicle, which the protesters refused. On the refusal army opened fire indiscriminately killing a civilian on the spot and injuries to other.

    Taking serious note of the situation, SP Poonch suspended the concerned SHO. Later the deputation comprising Panches (village sub-heads) and Sarpanches (village heads) of the area met Deputy Commissioner, Poonch at Mandi. He ordered a judicial probe into the firing incident and appointed SDM, Mendhar as enquiry officer. He was asked to submit the enquiry report within a week time.
Sources however, said that the protest continued on second consecutive day. The protesters put the body of victim on the mid of road and demanded compensation for the next of the victim’s kin.

CRPF MAN KILLES SEVEN COLLEAGUES
Baramulla, Nov 28:
A Central Reserve Police Force (CRPF) constable went berserk on 26th November night killing seven of his colleagues including three officers, before being shot dead in the battalion headquarters. Two CRPF personnel. were also injured in the shoot out. Officials said constable, Samrendra Deka of CRPF 152 battallion fired indiscriminately on his colleagues after his altercation with a havaldar during routine evening roll call. Seven CRPF personnel died on the spot. Samendra was later killed by the troops.

    Talking to media persons, Inspector General CRPF, Ranbir Singh said, preliminary investigation has revealed the constable was put under disciplinary punishment and had some family problem, which resulted in the incident. The killed personnel were identified as inspector Sadhu Ram, sub inspector Chandra Ram, Havaldar Krishen Dev Sharma, constable, Tarik Nath, constable, Mariya Pillia, Kuldeep Singh and Hardeep Singh. Refusal of leave to join there (personnel) families have been a major reason for the troopers going berserk and training guns on their colleagues, officials believe.

50 DETAINEES TO BE RELEASED BEFORE EID
Srinagar, Nov 2: Chief Minister, Mufti Muhammad Sayeed announced that 50 detainees languishing in various detention centres of the state would be released on the eve of Eid-ul-Fitr (Muslim festival). The government has decided to release the detainees on Eid so that they could celebrate the festival with their family” he said. On the number of the detainees presently lodged in jails, he said 500 detainees including 130 foreigners are in the detention centres.

    The Chief Minister made the announcement during a press conference on completion of two years of PDP led coalition government in the state. When asked if the centre is hindering the release of detainees after including its members in the screening committee, Mufti said the release of the detainees is ordered after getting clearance from these members as they are linked with different security agencies.

PROTEST AGAINST CRPF AT DODA
Doda, Nov 4:
Scores of students of various schools took to the streets to protest against the alleged torture of students by the personnel of Centre Reserve Police Force (CRPF) in the Doda district of Jammu provision. The students also held dharna (sit in) in front of the Deputy Commissioner Office demanding stern action against the erring cops. The protesters were however, pacified after the intervention of District Development Commissioner, Gulzar Ahmed Qureshi who assured them to lodging FIR against the erring cops.

BUS CONDUCTOR BEAT UP BY SECURITY FORCES
Sopore, Nov 7:
A Border Security Forces (BSF) trooper allegedly beat up a bus conductor in massive presence of people in Sopore area of north Kashmir for keeping the window of his vehicle open. People in hundreds protest the BSF’s unjustified action.

    According to sources, a BSF trooper signalled the driver of the matador bearing registration no. JK 05-5664 to stop near rest house, Sopore. Thereafter, brought down its conductor Sharif-ud-Din Mala of Malaganipora and gave him a severe beating. Quickly, hundreds of people assembled on the road and chanted anti-government and anti-troops slogans. The demonstration resulted into blocked of traffic on Sopore-Kupwara highway for hours. They protesters were demanding action against the trooper. State police made attempts to pacify the protesters but without any success.

YOUTH DISAPPEARS
Kupwara Nov 9:
Twenty-four-year-old Mushtaq Ahmad Dar resident of Gulgam, Kupwara is reportedly disappeared from September 2004. Mushtaq Ahmad, a shawl businessman by profession was kidnapped by two unidentified men on September 6 this year. Despite frequent visits to security forces camps, police stations and various officers, his family has failed to trace his whereabouts. Although, FIR has been registered in this connection, Kupwara police has failed to trace Mushtaq. Talking to The Informative Missive his father, Abdul Gani Dar, says his son was not involved in any militant or political activity.

ANOTHER YOUTH DISAPPEARS
Srinagar, Nov 9:
One person identified as Mushtaq Ahmed Bhat s/o Late Ghulam Ahmed Bhat of Urigam is reportedly missing since October 22-2004. On Oct 22, Bhat left his home and then didn’t return back. The relatives have filed a case in police station, Beerwah.

SOLDIER HANGS HIMSELF
Srinagar, Nov 29:
A soldier Lance Naik Milan of 26 Dogra Regiment on Nov 29 hanged himself to death from the ceiling of the bunker he was posted in, outside Camp Haider Beigh Pattan, Baramulla. However the cause of his death was yet to be ascertained.
